Biochemistry and molecular biology have been focusing on the structural, catalytic, and regulatory proper- ties of individual macromolecules from the perspective of clarifying the mechanisms of metabolism and gene expression. Complete genomes of ‘primitive’ living organisms seem to be substantially larger than necessary for metabolism and gene expression alone. This is in line with the findings of silent phenotypes for supposedly important genes, apparent redundancy of functions, and variegated networks of signal transduction and transcription factors. Here we propose that evolutionary (...) optimization has been much more intensive than to lead to the bare minima necessary for autonomous life. Much more complex organisms prevail. Much of this complexity arises in the nonlinear interactions between cellular macromolecules and in subtle differences between paralogs (isoenzymes). The complexity can only be understood when analyzed quantitatively, for which quantitative experimentation is needed in living systems that are as simple and manipulatable as possible, yet complex in the above sense. We illustrate this for the glutamine synthetase cascade in Escherichia coli. By reviewing recent molecular findings, we show that this cascade is much more complex than necessary for simple regulation of ammonia assimilation. Simulations suggest that the function of this complexity may lie in quasi-intelligent behavior, including conditioning and learning. (shrink)

The popular view of shareholder activism focuses on shareholder resolutions and the shareholder vote via proxy statements at the annual meeting, which is treated as a "David vs. Goliath" showdown between the small group of socially responsible investors and the powerful corporation. This article goes beyond the popular view to examine where the real action typically occurs-in the Dialogue process where corporations and shareholder activist groups mutually agree to ongoing communications to deal with a serious social issue. Use of the (...) capitalized word "Dialogue" is intended to distinguish this formal process between corporations and shareholders from all the other forms of dialogue or twoway communication exchanged between a corporation and its stakeholders. The phenomenon of Dialogue between a corporation and dissident shareholders has not been analyzed in the academic literature or in the popular press because it occurs behind the scenes and out of sight from media scrutiny. Yet this is where a great deal of social change initiated by shareholder activists is negotiated. This article contributes both theoretically and empirically to the study of Dialogues between shareholder activists and corporations. We explain how Dialogues occur in the context of the shareholder resolution process and examine two Dialogues that focus on international labor issues in two industries. Then data on Dialogues during the period, 1999-2005, from the Interfaith Center on Corporate Responsibility are analyzed. This research contributes to knowledge about the Dialogue process and the emerging literature on corporation-stakeholder engagement. (shrink)

This empirical study examines corporate responses to activist shareholder groups filing social-policy shareholder resolutions. Using resource dependency theory as our conceptual framing, we identify some of the drivers of corporate responses to shareholder activists. This study departs from previous studies by including a fourth possible corporate response, engaging in dialogue. Dialogue, an alternative to shareholder resolutions filed by activists, is a process in which corporations and activist shareholder groups mutually agree to engage in ongoing negotiations to deal with social issues. Based on a unique dataset of resolutions filed by member organizations of the Interfaith Center on Corporate Responsibility from 2002 to 2005 and the outcomes of these resolutions, our analysis finds that corporate managers are more likely to engage in dialogue with shareholder activists when the firm is larger, is more responsive to stakeholders, the CEO is the board chair, and the firm has a relatively lower percentage of institutional investors. While the literature on corporate social responsibility (CSR) suggests that its form and content differ at least somewhat from country to country, it has not begun to address whether CSR practices converge or diverge over time as countries benefit from higher levels of economic development, or whether these practices relate to specific cultural values and institutional structures. This paper proposes an initial conceptual model and propositions to begin to assess whether and how the different levels of economic development, cultural values, (...) and institutional structures influence CSR behaviors. Mediating variables related to industry sector and executive moral development are also included in the model. The conventional view of the relationship between ratings of corporate social responsibility (CSR) and responses to activist shareholder resolutions is that firms with low CSR ratings are likely to resist activist’s pressures to change corporate policies and behavior. By contrast, firms with high CSR ratings are more likely to support such activist shareholder efforts. In the IABS discussionsession and this paper, we argue that the conventional view of corporate responses to shareholder resolutions is inadequate to explain the motivations, strategies, and (...) tactics of firms when they respond to activist shareholders. Philosophers and scientists from all over the world, thirty seven in all, comment on Kuipers' philosophy, and each of their commentaries is followed by a reply from Kuipers. The present volume focuses on Kuipers' views on confirmation, empirical progress, and truth approximation, as laid down in his From Instrumentalism to Constructive Realism (Kluwer, 2000). In this book, Kuipers offered a (...) synthesis of Carnap's and Hempel's confirmation theory on the one hand, and Popper's theory of truth approximation on the other. The key element of this synthesis is a sophisticated methodology, which enables the evaluation of theories in terms of their problems and successes (even if the theories are already falsified), and which also fits well with the claim that one theory is closer to the truth than another. This article seeks to state, first, what traditionally has been assumed must be the case in order for an infinite epistemic regress to arise. It identifies three assumptions. Next it discusses Jeanne Peijnenburg's and David Atkinson's setting up of their argument for the claim that some infinite epistemic regresses can actually be completed and hence that, in addition to foundationalism, coherentism, and infinitism, there is yet another solution (if only a partial one) to the traditional epistemic regress problem. The (...) article argues that Peijnenburg and Atkinson fail to address the traditional regress problem, as they don't adopt all of the three assumptions that underlie the traditional regress problem. It also points to a problem in the notion of making probable that Peijnenburg and Atkinson use in their account of justification. (shrink)

The inventive, argumentative and stylistic possibilities generated by figures in general and the figure antithesis in particular are explored by Jeanne Fahnestock in the field of science. These ideas on the possibilities of antithesis are developed in the analysis of some cases of this figure in the media. This paper explores how antithesis can consist of textual and visual elements, and how various sorts and degrees of opposition are constructed in the figure.

Formulating how biomimicry relates to nature has been crucial to ‘deepening’ its theory. Currently, an autopoietic model of nature dominates the literature. However, advances in the natural and human sciences have demonstrated that autopoiesis does not adequately explain complex, dynamic, responsive, and situated systems. This article draws on Beth Dempster’s (1998) characterisation of ecosystems as sympoietic, that is as homeorhetic, evolutionary, distributively controlled, unpredictable, and adaptive, and on Donna Jeanne Haraway’s (2016) critique that entities do not pre-exist their relationships. (...) We argue that using sympoietic processes of becoming as our model, measure, and mentor impacts biomimicry’s practice and relation to sustainability. Taking John Todd’s Living Machines as a case study, we explicate how sympoiesis unfurls autopoiesis. By integrating advances in the natural and human sciences into the philosophy of biomimicry, we address the limitations of the autopoietic model and provide a more comprehensive and adequate model of ‘nature.’. Today, many visual artists are giving the cold shoulder to the static, isolated concept of visual art and searching instead for novel, dynamic connections to different image strategies. Because of that, visual art and aesthetics are both forced to reconsider their current positions and their traditional apparatus of concepts. In that process, many questions surface. To mention a few: Could the characteristics of an artistic image and its specific manner of signification be determined in a world which is entirely aesthetisized? (...) What would be the consequences of a variety of image strategies for aesthetic experience? Would it be possible to develop a form of cultural criticism by means of artistic activities in a culture awash in images? In order to answer such questions, aesthetics as a philosophy of art needs to transform its field into a critical philosophy of topical visual culture. As an impetus to such a reinterpretation of the visual working area, the L & B Series organized three symposia evenings under the title “Exploding Aesthetics”, in cooperation with De Appel Center for Contemporary Art, Amsterdam. Besides the presentations and discussions from these symposia, this volume includes various arguments, positions, and statements in both articles and interviews by a variety of visual artists, designers, advertising professionals, theorists and curators. This Open Access book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary way. Taking seriously the idea that good reasons are (...) typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. This study investigates the use of specific educative features for supporting the teaching of nature of science during read-alouds of elementary science trade books. Educative features are components of educative curriculum materials that aim to increase teachers’ content knowledge and support effective instructional practices. Understanding how teachers use specific educative features is important for the future design of curriculum materials that can be used to improve teachers’ views of NOS in tandem with changing their teaching practices. Qualitative data from teacher (...) interviews and observations of read-alouds were used to determine which educative features teachers used and how effective they were perceived as being. Results indicate that teachers varied in their use of educative features and tended to focus on the ones that addressed specific teaching moves as opposed to those that supported understanding why the curriculum was developed as it was. Based on these findings, recommendations for future research that highlights the importance of all educative features are provided. (shrink)

Bas . van Fraassen, one of the world’s foremost contributors to philosophical logic and the philosophy of science, here undertakes a fresh consideration of these questions and offers a program for renewal of the empiricist tradition. The empiricist tradition is not and could not be defined by common doctrines, but embodies a certain stance in philosophy, van Fraassen says. This stance is displayed first of all in a searing, recurrent critique of metaphysics, (...) and secondly in a focus on experience that requires a voluntarist view of belief and opinion. Van Fraassen focuses on the philosophical problems of scientific and conceptual revolutions and on the not unrelated ruptures between religious and secular ways of seeing or conceiving of ourselves. Madonna Towers, Inc., the U.S. Court of Appeals for the Eighth Circuit held that the failure of a skilled nursing facility's executives to seek a legal opinion regarding a billing practice they considered valid did not meet the definition of knowingly presenting a false claim for payment to the federal government under the False Claims Act. Alleging that the facility that provided care to his aunt fraudulently submitted claims to Medicare for services provided (...) free of charge, the appellant brought this case qui tam on behalf of the federal government under the FCA.The FCA was passed by the legislature in an effort to punish and deter fraud against the federal government. In the cities of industrialized countries, the sudden keen interest in urban agriculture has resulted, inter alia, in the growth of the number and diversity of urban collective gardens. While the multifunctionality of collective gardens is well known, individual gardeners’ motivations have still not been thoroughly investigated. The aim of this article is to explore the role, for the gardeners, of the food function as one of the functions of gardens, and to establish whether and how this function is a (...) motivating factor for them. We draw on a set of data from semi-structured interviews with 39 gardeners in 12 collective gardens in Paris and Montreal, as well as from a survey on 98 gardeners and from field observations of the gardeners’ practices. In the first part we present the nature and diversity of garden produce, and the gardeners’ assessment thereof. In the second part we describe the seven other functions mentioned by the gardeners, which enables us to situate the food function in relation to them. We conclude that the food function is the most significant function of the gardens, and discuss the implications for practitioners and policy makers. (shrink)

The role of Human Research Ethics Committees (HRECs) in health research is well established. Ethics committees have the good of research participants in mind but they must also assess scientific merit including the design and conduct of studies. In this article the authors’ focus is on qualitative research method and the challenge that the National Statement on Ethical Conduct in Human Research (2007) poses for ethics committees when they assess proposals using the methods outlined in the National Statement.We set out (...) a process for judging the standard of qualitative research proposals and propose that qualitative health research can be assessed using a hierarchy designed for evaluating interview studies. We contrast well-designed studies with those that have design flaws in order to focus on the hallmarks of research merit in studies that use qualitative research methods. Finally, we show that our proposal is compatible with the National Statement.Ethics review provides an early opportunity to identify and redesign inadequate studies that will not contribute to our knowledge base. The challenge for members of ethics committees with little experience in qualitative studies is to be able to assess research excellence by assessing research merit in proposals, recognising the special design features of qualitative research methods. We then distinguish the concept of global business citizenship from “corporate citizenship” by showing how the former concept requires a transition from communitarian thinking to a position of universal human rights. In addition, we link global (...) business citizenship to global business strategy and to three analytical levels of ethical norms.
